If I Receive an assessment or education services in a licensed facility that is not a certified DUI program, will the assessment and education services count toward fulfilling the requirements for other DUI convictions? Answer: No. Kentucky Administrative Regulation 908 KAR 1:310 Section 3(a) states: "A licensed entity desiring to provide DUI assessment or education services shall be certified by the division as a DUI program before providing a service at any location."

Can education programs be less than 90 days long? Answer: Yes. The delivery standards in administrative regulation 908 KAR 1:310 Section 7(2) for both the Kentucky Alcohol and Other Drug Education Program (KAODEP) and the Prime For Life (PRI) curricula allow for the delivery of the 20-hour education program in less than 90 days. Since KRS 189A restricts education to first offenders, and KRS 189A.040(1)(c) allows for release from the program prior to 90 days for a first offender who has completed the recommended program based on an assessment, it is clear that an education program can be completed in less than 90 days. Ninety days is the maximum length of an education or treatment program for a first offender.

Must the client be informed of total cost of DUI services prior to enrollment? Answer: KRS 189A makes no reference to notifying defendants of total costs for DUI services prior to enrollment. The language in the statue related to the need for a client "to pay the amount specified by the court" has been interpreted to apply in cases of indigency only. A defendant is required to complete the program ordered by the court and this includes paying the fees established by the selected program. However, administrative regulation 908 KAR 1:310 Section 3(8) specifically addresses notifying clients of fees prior to the delivery of services with the following language: (b) The fee schedule published in the DUI directory shall be posted in a public area of each facility visible to a client. (d) A program shall explain the program's fee and payment requirements to the client at the time of his assessment or upon enrollment in education or admission to treatment, if the client is referred to another program after receiving an assessment. (e) A program shall not charge a client a fee unless the client has signed a fee agreement.

If a client has a valid Kentucky license, and he or she receives a DUI in another state, which state's DUI requirements does the client have to fulfill? Answer: Both states.

If the state where a Kentucky licensee received his DUI does not take his license, is his Kentucky driver's license still valid, and how would the client know whether he is driving with a valid or invalid Kentucky driver's license? Answer: Report completion to the Kentucky Transportation Cabinet. Contact the convicting court and the other state's DUI office for any additional reporting requirements.

If an individual has a valid driver's license from another state and gets a DUI in Kentucky, which state's DUI requirements does the client have to fulfill? Answer: The other state's.

In the case above, to which court/and or DOT does the DUI program report enrollment and completion? Answer: Report enrollment to the convicting court. Report completion to the convicting court and to the Kentucky Transportation Cabinet. Contact the other state's DUI office for any additional reporting requirements.

If Kentucky does not take an individual's out-of-state driver license, is his out-of-state driver's license still valid in Kentucky, and how would the individual find out? Answer: The Division of Drivers Licensing in the Kentucky Transportation Cabinet begins the license or driving privilege suspension period on the day the court convicts the driver of DUI. This principle applies to both an in-state conviction for an out-of-state driver or a Kentucky licensee who receives a DUI in a sister jurisdiction.
